While Philippines has superior
legal claim to China—controlled Panatag Shoal, it is then "illegally
occupying" the two other small islands in Kalayaan island group that
is claimed by Vietnam, this was said by a research firm based in United States.
Researchers from the Virginia—based
think tank argued that Philippines cannot lawfully classify whole Kalayaan
group under its sovereignty rights.
Two maritime features under the Kalayaan
— Thitu Island and Loaita Island were also claimed by Vietnam devolve from legal
annexation of its document issued by French colony in the year 1933.
"Legal occupation by France at the
time, lawful territorial method of acquisition, and its rights was devolved to
Vietnam," research stated.
The said annexation was then backed
by France's maritime activities prior to the World War II as well as the evidence
that claims were not abandoned after the stated war, as what the paper noted.
“Now Philippines were illegally
occupying the two small islands in KIG that the rightful property of Vietnam,"
noted by the paper's legal conclusions.
