Supreme Court Stops Pacquiao’s tax case vs BIR

The Supreme Court (SC) issued a TRO (temporary restraining order) to the Bureau of Internal Revenue on the Php3.2 billion tax case against Pacquaio.

The third division tribunal issued resolution to stop the implementation of the Tax Appeals requiring Pacuaio and his behalf to post cash bond of Php3.2 billion surety bond.



The high court stopped BIR from collecting Php2 billion worth taxes from Pacquiao. Both parties were asked to comment on Pacquiao’s petition in a period of 10 days.

Pacquiao earlier sought break from high court through a 75-page petition seeking to invalidate the appellate tax court's order allowing BIR to collect the said amount and denying petitioner's motion for fractional reconsideration.

Pacquaio’s lawyers said that the requirement was "effectively an unfeasible condition" as their net worth was only P1.18 billion.

Pacquiao and his behalf decried the BIR's violation to the constitutional rights to due process "in presuming the exactness of a fraud judgment without evidentiary support other than the issuance of the deceit assessments themselves."


The Petitioners accused BIR Commissioner Henares of violating procedural requirements on tax summary collection remedies under the Section 208 of the Philippine Tax Code when she failed to serve supplicants with warrants of garnishment touching their bank accounts.
