Philippine Vice President Binay
has all the right to refuse Senate’s invitation on him to appear on the senate inquiry
on the alleged overpricing of Makati Building 2.
Romulo Macalintal on a press
statement said that Binay “could not be forced” to testify on the
Senate Blue Ribbon Committee, who has invited him to air his side on the allegations
that he have earned kickbacks on the construction of Php2.28—billion building when he was still the mayor of Makati City.
Macalintal said that the
protection accorded to a sitting president from the Congress subpoeanas under doctrine
of separation of the powers extends to vice president.
“If the Congress cannot subpoena
the country’s President, then the same thing should be applied to the Vice
President considering that Office of Vice President is a component of Executive
Department of government,” Macalintal said.
