The camp of the Makati Mayor Binay
asking Senate panel that investigates alleged corruption in Makati to submit to
him list of questions that will be asked during the said senate hearing.
A letter of response to the served
subpoena on Binay last October 28, mayor’s counsel said that Binay should be given
a list of questions that will be asked on the mayor for him to have time to
prepare possible answers and the needed documents.
Cerveza also added that under the
jurisprudence, “requesting any answers in advance is already a reasonable measure for the
party invited to an investigation for him to satisfy that the said inquiry aid
of legislation and within constitutional power of the Congress.”
Cerveza cited the April 2006 SC decision
on “Senate vs Ermita.”
So with that issue our client
Mayor Binay has right to request from the said subcommittee for the needed
information. Cerveza said.
Binay was already served subpoena
to appear before Senate October 30 but again failed to attend.
Cerveza also noted that why Binay
still need to attend when he already explained everything when attended previous
hearings.
