The Philippine lady Senator Defensor
Santiago said that VP Binay’s continued refusal to attend the Senate hearing on
corruption allegations against him is "forum shopping" that
is prohibited and penalized by Supreme Court.
In a speech at PCU (Philippine
Christian University), Senator Santiago said that it is not enough for VP Binay
to defend himself by just simply delivering speeches.
Senator Santiago said also that Binay
must present counter—evidence at Senate hearing if he does not want his silence
be construed as implied guild admission.
The lady senator described VP Binay's
silence to the present evidence as very "alarming."
"Binay promises to make a detailed
defense not in the Senate hearing, but in the Ombudsman, where he is facing
plunder and other criminal charges. Unfortunately, the law does not allow Binay
to just choose the forum where he shall make his defense," santiago
said.
Senator Santiago also said that Binay's
attempt to escape the scrutiny of Senate is similar to a forum shopping that is
prohibited in courts which, according to SC, takes place "when
a person avails of several judicial remedies in different courts, raising
substantially the same issues."
